Usoolul Fiqh is needed because:-


1 Language (The sahaabah possessed the pure Arabic and knew the dialects and contextual usage, they could question directly about that which they did not know, whether this was related to the language or shari’ah meanings)

2 Conflict of evidence (The conflicts of the wahi need to be resolved through various methods whereas they were rare for the sahaabah because the wahi was revealed in stages among them and about them)

3 Completion of wahi (Now the wahi is complete, we must apply it all at once without the immediate wahi of Nabi (saw) this then will involve prioritization due to conflicting circumstances etc. [fiqhun nawaazil etc])

4 Transmission of texts (Verification of transmission is not necessary for those who are present and it is easy for the following one or two generations but after this it is more difficult as is established by wahi and by ration)

5 Verification of Texts and Meanings (The sahaabah could do this because of the presence of Nabi (saw) either by questioning or because the meaning was obvious or by questioning those who witnessed)

6 The tools of extraction

7 Circumstances (The circumstances explains the meaning and restricts the application)

8 Abrogation (The abrogation was clearer among the sahaabah because they were living with the wahi rather than collecting it or looking at the ayaat and ahadeeth all at once, the texts do not necessarily mention that they are abrogated nor that they are abrogating)

9 Absence of the best three generations (They mutually verified meanings and texts with those who had direct or indirect knowledge to it)Role of Mind:-In Usoolud Deen

iv) To seek the best, easiest and most appropriate means e.g. Da’wah “Invite them to the way of your Lord with hikmah, mawizatul hasanah and debate with best means” (an Nahl 16:125), Jihaad “Prepare all you can of force and fighting horses in order to frighten” (al Anfaal) Aishah “Nabi chose easiest of two as long as not sin” (BUKHAARI)
